About this tool
This online litigation fee calculator follows the State Council's Measures on Payment of Litigation Fees (effective 1 April 2007). It covers acceptance fees for property, marriage, labor, IP and other case types, plus execution application fees, preservation fees and payment orders.
Fee types explained
Case acceptance fee
The fee payable when filing a civil action with a people's court. It is calculated by case type and claim amount at the statutory rates.
Execution application fee
The fee for applying to a people's court to enforce an effective legal instrument, based on the execution amount and borne by the judgment debtor.
Preservation fee
The fee for applying for preservation of property, based on the preserved amount with a cap of CNY 5,000 per case.
Payment order
The fee a creditor pays when applying for a court payment order - one third of the property-case acceptance fee.
FAQ
- Who pays the litigation fee?
- The acceptance fee is prepaid by the plaintiff and ultimately borne by the losing party. When each side partially wins, the court decides how the parties share the costs.
- Which cases qualify for a fee reduction or waiver?
- Judicial aid may reduce or waive fees where, for example: 1) the claimant is a disabled person without a fixed income; 2) the claim seeks support, custody, maintenance or pension payments; 3) the claimant is a subsistence allowance recipient or a rural recipient of regular poverty relief.
- Is the fee halved under the summary procedure?
- Yes. Cases tried under the summary procedure pay half the acceptance fee. Cases concluded by mediation or withdrawn by the plaintiff also pay half.
- How accurate is the result?
- This tool follows the Measures on Payment of Litigation Fees exactly, so the calculation is reliable - but the final amount is the one on the court's fee notice.
- Is there a cap on preservation fees?
- Yes. Under the Measures on Payment of Litigation Fees, preservation fees are charged by tier on the preserved amount, but never exceed CNY 5,000 per case.
